NACE adds California Proposition 65 Compliance Officer

 

 

June 29, 2018 – West Chester, PA – North American Cable Equipment, Inc. (NACE), a leading provider of video transport and management solutions, announced today it will leverage existing in house compliance expertise and created a new standalone firm-wide compliance function known as the NACE Proposition 65 Compliance Officer.  Current employee Stan Presley has stepped up to fulfil the duties associated with the position.

 

The NACE Proposition 65 Compliance Officer is a completely new position for the company. The position oversees the Corporate Compliance Program as it relates to California Proposition 65 regulations. This position functions as an independent and objective body that reviews and evaluates California Proposition 65 compliance issues/concerns within the organization. The position ensures that management and employees are taking the steps to be in compliance with the rules and regulations for California Proposition 65, that company policies and procedures related to California Proposition 65 are being followed and that behavior in the organization meets the company’s Standards of Conduct with regard to California Proposition 65.

 

Proposition 65 requires an entity who exposes an individual in California to a chemical deemed by the state to cause cancer or reproductive toxicity to give "a clear and reasonable warning". Failure to give the required warning is punishable by significant civil penalties, injunctive relief, and the obligation to pay plaintiff's costs and attorney's fees.

 

Proposition 65 is enforced through civil lawsuits with a penalty phase that can put a company out of business due to the high dollar amount of penalties.  Currently insurance companies are not offering protection against California Proposition 65 so it is imperative all businesses whose products are used in the state of California are fully compliant.

 

Through Stan’s career he has established a proven record of understanding and enforcing compliance practices. “Raising awareness of risk, performing training, and giving sound advice are critical elements of the NACE Proposition 65 Compliance Officer’s mission. The International Compliance Association breaks down the role of a compliance officer into two levels of responsibility:

 

Level 1: compliance with the external rules that are imposed upon an organization as a whole

 

Level 2: compliance with internal systems of control that are imposed to achieve compliance with the externally imposed rules.

 

In this regard Stan will have the duties and responsibilities to:

 

Develop initiate, maintains and revises policies and procedures for the operation of the NACE California Proposition 65 Compliance Program and its related activities to prevent illegal, unethical, or improper conduct.

 

Manage the day-to-day operation of the Program.

 

Develop and periodically review and update Standards of compliance for the NACE California Proposition 65 Compliance Program to ensure continuing currency and relevance in providing guidance to management and employees.

 

Collaborates with other departments (e.g., Purchasing, Shipping, Warehouse, Vendor relations, Product, Risk Management, Internal Audit, Employee Services, etc.) to direct California Proposition 65 compliance issues to appropriate existing channels for investigation and resolution. Consults with the corporate attorney as needed to resolve difficult California Proposition 65 legal compliance issues.

Respond to California Proposition 65 alleged violations of rules, regulations, policies, procedures, and Standards of Conduct by evaluating or recommending the initiation of investigative procedures. Develop and oversees a system for uniform handling of such violations.

 

Act as an independent review and evaluation body to ensure that California Proposition 65 compliance Issues/concerns within the organization are being appropriately evaluated, investigated and resolved.
